Legislation requiring front-of-package nutritional labeling (FOPNL) information for foods high in sugar and salt is being widely adopted around the world. These country reports assess the landscape by identifying current FOPNL regulations, assessing the future of FOPNL legislation and highlighting future potential regulatory dangers for the chocolate & confectionery industry. The report is taken from NCA’s Global Confectionery Report on Front-of-Pack Labeling Initiatives.

This country report includes analysis of how 500 consumers in each country responded to a survey on their chocolate & confectionery purchasing habits and how these are likely to be impacted by regulatory initiatives such as FOPNL. The report also includes a number of themes coming from a range of expert interviews conducted with confectionery manufacturers, retailers, policy makers and other representatives from the confectionery industry.

The report begins with a Global Executive Summary of findings and continues with an examination of each country specifically through the survey results and expert interviews.

Dr. Susan Mayne will give a broad overview of the Center’s activities to carry out its public health mission. This presentation will cover FDA-led initiatives outlined in the September 2022 “Biden-Harris Administration National Strategy on Hunger, Nutrition, and Health,” including empowering consumers to make and have access to healthy food choices through a suite of policy initiatives involving labeling and other tools to create a healthier food supply for all; modernizing innovative approaches to prevent foodborne illness; and reducing toxic elements and chemicals in food.

Food Safety Update

What are the key food safety issues in 2022 and beyond? Hear the latest regulatory updates in food safety and enforcement. This session will cover a wide range of current topics, including allergen controls, inspections and enforcement activities, implementation of the FDA’s New Era of Smarter Food Safety initiative and chemical contaminants in foods. Receive the status of each of these and a crystal ball outlook for the coming year.

Tish Pahl will provide an update on federal cannabis legislative proposals, state-level legalization and federal regulatory activity. There are dozens of legislative attempts to reform federal cannabis law, including the Marijuana Opportunity Reinvestment and Expungement (MORE) Act, the Cannabis Administration and Opportunity Act (CAOA) and the SAFE Banking Act. In addition, the 2023 farm bill will likely have important impacts on the use of certain cannabis-derived ingredients in foods and dietary supplements. As Congress continues to consider federal cannabis reform, states have continued to legalize medical and recreational cannabis use. Tish will discuss these various federal and state efforts, including prospects for federal action, what is likely to change in the U.S. with the November election and what the FDA and FTC have been doing (and not doing) in the meantime.

  • The presentation will provide an overview of the conference and the administration’s national strategy to end hunger and increase healthy eating and physical activity by 2030 so fewer Americans experience diet-related diseases—while reducing related health disparities. Recommendations and actions that impact the confectionery industry will be highlighted.

Dietary Guidelines for Americans

  • The presentation will provide an overview on the purpose and process of the Dietary Guidelines for Americans and the current work on the new 2025-2030 Dietary Guidelines. Topics and questions of importance to the confectionery industry identified by the Departments of Health and Human Services and Agriculture for review by the Dietary Guidelines Advisory Committee for 2025-2030 edition will be highlighted.

Food and Nutrition Labeling Update

This presentation will cover hot topics emerging or ongoing with the FDA and key areas of state concern will be covered:

  • Front-of-pack labeling appears to be a policy issue that the FDA will be addressing soon, along with a regulatory definition for “healthy”.
  • How the FDA will address ingredient substitutions as the COVID-19 Public Health Emergency ends but supply chain issues persist.
  • State Plaintiff Attorneys are more prevalent than ever; emerging areas of focus include allegations of misrepresenting sustainability (or ESG), protein content and serving size.

Farida Mohamedshah is the senior vice-president of scientific and regulatory affairs at NCA, overseeing the association’s relationships with industry regulators and providing member companies with information on nutrition, food safety and other regulations that impact the manufacturing, distribution and sale of confectionery items.

Before joining NCA, Mohamedshah was the director of food, health and nutrition at the Institute of Food Technologists, serving as the group’s principal scientific and technical resource on these topics. She has published papers in the fields of nutrition and food science, and is a member of the American Society for Nutrition and the Academy of Nutrition and Dietetics. As a nutritionist, she worked on a GRAS dossier and reviews for health and structure function claims for nutrients and bioactive components.

Mohamedshah has a Bachelor of Science in Home Economics and a Master of Science in Textile Chemistry and Clothing from the University of Bombay and a Master of Science in Human Nutrition & Food Systems from the University of Maryland.

Director of the Center for Food Safety and Applied Nutrition
Food and Drug Administration
Susan Mayne is the director of the Center for Food Safety and Applied Nutrition at the FDA. In this position, Dr. Mayne leads the Center’s development and implementation of programs and policies related to the safety and labeling of foods, food and color additives, and cosmetics. The Center for Food Safety and Applied Nutrition’s responsibilities also include fostering the development of healthier foods and ensuring that consumers have access to accurate and useful information to make healthy food choices.

An internationally recognized public health leader and scientist, Dr. Mayne received a B.A. in chemistry from the University of Colorado. She earned a Ph.D. in nutritional sciences, with minors in biochemistry and toxicology, from Cornell University.

Prior to joining the FDA in January 2015, she spent nearly three decades at Yale University, where she held an endowed chair as the C.E.A. Winslow Professor of Epidemiology. Her distinguished career there included two leadership positions: Chair of the Department of Chronic Disease Epidemiology and Associate Director of the Yale Cancer Center.

Dr. Mayne has conducted extensive research on food, nutrition and health. She is the author or coauthor of nearly 250 scientific publications, and her work has been cited more than 17,000 times.

She completed two consecutive terms on the Food and Nutrition Board of the National Academy of Sciences and a five-year term on the Board of Scientific Counselors for the U.S. National Cancer Institute.

Allie Graham is the Senior Director of Food Policy and Global Regulatory Affairs at Food Directions. Allie manages client’s policy and regulatory priorities for food, nutrition, and food labeling. Until August 2019, she worked as a Science and Regulatory Manager at Grocery Manufacturers Association (GMA, now Consumer Brands Association) supporting the development and implementation of domestic/international food labeling standards and nutrition policy positions. Allie earned her Master’s degree in Nutrition with a focus on Global Nutrition Education from University of New Haven and trained as a Registered Dietitian at Yale New Haven Hospital. Bob Falk is an attorney, strategic consultant, and certified mediator primarily focused on California’s unique Proposition 65 warnings law. He is special counsel to NCA and several other trade associations regarding Proposition 65 and other California regulatory matters. Bob has negotiated and drafted more Proposition 65 settlements than anyone and has led or participated in numerous related mediations and court proceedings. He previously represented and counseled a wide variety of clients as a partner at the San Francisco-based law firm of Morrison & Foerster LLP.

Bob’s expertise in Proposition 65 has been widely recognized. Legal 500 recommended him for such work as a “personable, professional, and a trusted adviser.” In addition, Bob has helped clients with FDA and CPSC requirements, California’s Unfair Competition and Consumer Legal Remedies statutes, and federal and state “green marketing” and “green chemistry” regulations.

Bob serves on the Advisory Board of Proposition 65 Clearinghouse and was a member of the American College of Environmental Lawyers.
